[00:13]

doctor did you serve you serve up

[00:16]

Committee heras of prepar the VM 3our

[00:21]

manual yes it Isle your professional

[00:25]

involvement in it your writings in the

[00:27]

area and your interest is that correct I

[00:30]

presume

[00:36]

so would you tell us what the term

[00:39]

paraphilia means and what is a

[00:45]

paraphilia the term paraphilia comes

[00:48]

from Greek roots and was

[00:52]

reintroduced in

[00:54]

1980 as

[00:56]

a means of getting away from the ch term

[01:00]

sexual deviation that had been used

[01:03]

before that time and the Greek Roots

[01:06]

refer to the idea that what a person

[01:09]

with a paraphilia is sexually attracted

[01:12]

to is something alongside the normal

[01:16]

other than the normal area of sexual

[01:19]

interest and each of the paraphilias for

[01:23]

which we have a name refers to a more or

[01:27]

less common

[01:31]

form that unusual sexual interests may

[01:37]

take now the fact is that anything or

[01:41]

just about anything can become sexually

[01:44]

attractive to an individual and all

[01:48]

manner

[01:49]

of unusual even bizarre sexual interests

[01:54]

are

[01:55]

observed but only some of them happen

[01:57]

often enough that it it's been useful to

[02:00]

develop a particular name for that kind

[02:04]

of sexual

[02:05]

attraction there's a recognition in dsm3

[02:08]

R and certainly among people who work in

[02:10]

this area that the names that happen to

[02:14]

be mentioned in the book are not quite

[02:17]

sufficient because there are so many

[02:19]

other kinds of sexual interests that can

[02:21]

occur and

[02:23]

become a particular preference or

[02:25]

interest of an individual and so to

[02:28]

accommodate those

[02:30]

other ones that aren't specifically

[02:33]

named or listed there is a heading

[02:36]

referring to paraphilia not otherwise

[02:39]

specified and it's possible to uh

[02:44]

identify very long list of kinds of

[02:47]

paraphilia that

[02:49]

exist but the word means no more than

[02:52]

what we used to mean by sexual deviation

[02:54]

in other words it is a pattern of an

[02:58]

enduring

[03:01]

sexual interest in a particular kind of

[03:06]

unusual

[03:08]

image it's considered that the ordinary

[03:11]

or

[03:12]

usual sexual image that someone finds

[03:15]

erotic is an adult human being who is

[03:19]

alive and when individuals find

[03:22]

something else sexually

[03:25]

exciting and persist in that pattern of

[03:28]

sexual excit

[03:30]

for long enough we happen to use 6

[03:33]

months as an arbitrary cut off point

[03:36]

then we label that a

[03:38]

paraphilia now there was one political

[03:41]

issue that came up during the dsm3 r

[03:45]

discussions about which there's some

[03:47]

disagreement and that is whether one

[03:50]

should

[03:51]

call a particular interest of

[03:54]

paraphilia if the person never acts on

[03:58]

it and

[04:00]

the way the debate was resolved was to

[04:03]

say that we will

[04:06]

only agree on using the term paraphilia

[04:09]

or the purposes for which dsm3 R was

[04:13]

devised when an individual has strong

[04:18]

sexual urges toward a particular unusual

[04:20]

be kind of activity and either is

[04:24]

bothered by those

[04:26]

urges or acts on them or

[04:30]

both so if a person has such

[04:34]

urges doesn't mind having them and

[04:37]

doesn't act on them it's technically not

[04:40]

a

[04:42]

paraphilia I was in the minority on that

[04:45]

particular vote because I think if

[04:46]

someone fantasizes torturing a woman

[04:50]

every time he has sex with his

[04:52]

wife it's a paraphilia even if it

[04:55]

doesn't bother

[04:57]

him but my colleagues out voted me and

[05:01]

think that it shouldn't be given a label

[05:03]

unless it bothers him or he acts on

[05:07]

it so a paraphilia is wanting to do some

[05:13]

unusual sexual

[05:17]

behavior repeatedly over at least six

[05:20]

months and either being bothered by

[05:23]

one's desires or acting on them can you

[05:27]

list some of the more commonly known and

[05:29]

recognized

[05:31]

paraphilias well some some of the more

[05:33]

familiar ones are exhibitionism in other

[05:36]

words individuals who have the desire to

[05:40]

expose themselves to unsuspecting

[05:42]

strangers if they

[05:45]

repeatedly uh for more than six months

[05:47]

have such desires and are either

[05:49]

bothered by that or act on it then

[05:52]

that's the diagnosis of exhibitionism a

[05:55]

kind of

[05:56]

paraphilia if an individual like one has

[06:00]

the interest in peeping into people's

[06:02]

windows and watching strangers undress

[06:04]

or have sex and is bothered by that or

[06:08]

does it for long enough then that's the

[06:11]

paraphilia of

[06:13]

voyerism if an

[06:15]

individual likes to make obscene phone

[06:18]

calls and is bothered by that or does it

[06:21]

for long enough that's the paraphilia of

[06:24]

telephone

[06:26]

scatalogia if an individual

[06:30]

wishes to rub up against unsuspecting

[06:33]

strangers as U men are known to do in

[06:35]

subways in New York and crowded

[06:37]

elevators everywhere then that is uh if

[06:42]

he does it or is bothered by the desire

[06:46]

the paraphilia of

[06:52]

furis if one wishes to have sexual

[06:55]

contact with a corpse and is either

[06:58]

bothered by the idea

[07:00]

or does it that's the paraphilia of

[07:04]

necrophilia if an individual wants to

[07:07]

have sexual activity with Children Under

[07:09]

12 and either does it or is bothered by

[07:13]

The Urge that's the paraphilia of

[07:17]

pedophilia all of those I think are

[07:20]

described specifically and uh are me at

[07:23]

least mentioned by name in dsm3 R but

[07:26]

that doesn't even begin to cover the TR

[07:29]

because there are so many unusual things

[07:32]

that people from time to time find

[07:35]

sexually

[07:36]

exciting um fetishism is another one

[07:39]

that's described there in which an

[07:41]

individual has a specific sexual

[07:43]

interest in some kind of inanimate

[07:46]

object or material such as latex or

[07:50]

leather garments or highheeled shoes or

[07:54]

some kind of underwear if someone wishes

[07:57]

their Partners to use such things or

[08:02]

likes to masturbate while fondling such

[08:04]

materials or things and they're either

[08:07]

bothered by that or act on it that's the

[08:11]

paraphilia of fetishism and all the

[08:13]

paraphilia are the same in being nothing

[08:16]

more than what it is someone wishes to

[08:21]

do technically we only give the label if

[08:24]

they wish to do it long enough and if

[08:27]

they're bothered by the wish or if do it

[08:30]

but it's nothing more than what they

[08:31]

have an urge to do and it is essentially

[08:34]

a sexual

[08:35]

urge yes this this to put it another way

[08:38]

I mean a more scientific way to make the

[08:40]

diagnosis really would be to to look at

[08:44]

what gives men an

[08:45]

erection

[08:47]

and that's how in a research laboratory

[08:50]

one Studies paraphilia by seeing what

[08:54]

stimuli will produce erection in the

[08:56]

male and if men regularly can become

[09:02]

direct to a particular kind of unusual

[09:04]

image then that is what scientifically

[09:08]

we mean by a

[09:10]

paraphilia so it has to do with what

[09:12]

what is a turn on now if it's a normal

[09:16]

kind of image that the culture accepts

[09:20]

then we don't call it a paraphilia so in

[09:23]

the United States no one would call it a

[09:25]

paraphilia for men to be attracted to

[09:28]

the kinds of women portrayed in Playboy

[09:30]

Centerfolds because many men will

[09:33]

respond to that image with an

[09:36]

erection um but if they're responding in

[09:39]

the same way to a picture of someone who

[09:41]

is bound and

[09:43]

chained that would be called a

[09:45]

paraphilia because that's not an

[09:46]

acceptable image in our culture so you

[09:49]

can see that to some extent it's what's

[09:52]

accepted by the culture in society that

[09:54]

determines which interests become

[09:57]

labeled paraphilias and and which do not

[10:01]

and the term paraphilia relates really

[10:03]

to what excites the person sexually it

[10:05]

does not as such apply to the strength

[10:07]

of the sexual drive would that be

[10:09]

accurate that that's very accurate the

[10:11]

strength of Sex Drive is something

[10:14]

altogether different from what it is one

[10:16]

wishes to do an

[10:18]

individual can have pedophilia that is

[10:21]

the attraction to children and yet have

[10:23]

a low sex drive and only be motivated to

[10:27]

have sex with a child once every six or

[10:29]

eight months and not to be particularly

[10:35]

motivated the rest of the time or an

[10:37]

individual can

[10:38]

have a high sex drive and also be

[10:41]

pedophilic and want to have sex with a

[10:44]

child many times a day the strength of

[10:46]

the drive is separate from whether they

[10:49]

have the paraphilia or not and people

[10:52]

have a lot of variation and the strength

[10:53]

of their sex drive but do some persons

[10:56]

have more than one pilia at the same

[10:58]

strike that more than one paraphilia at

[11:00]

the same time yes it's it's quite common

[11:02]

for individuals to have multiple

[11:05]

paraphilias

[11:06]

simultaneously that's

[11:09]

partly a byproduct of the way we

[11:13]

classify the paraphilias we've broken

[11:16]

the more common forms down into clusters

[11:20]

that we've given names and because of

[11:22]

the way we've named named them someone

[11:25]

who likes to expose himself and make a

[11:28]

scene phone calls would have be given

[11:30]

two

[11:31]

paraphilias but we could have named it

[11:33]

differently we could have said that

[11:36]

we'll call it a particular paraphilia of

[11:38]

courtship a courtship disorder if

[11:40]

someone goes about interrupted courting

[11:44]

rituals and either just exposes himself

[11:47]

or makes phone calls or just touches

[11:49]

people or rubs against them those are

[11:51]

all examples

[11:54]

of tidbits of normal courting Behavior

[11:57]

because in a normal courtship one would

[11:59]

look at people and call them on the

[12:00]

phone and there'd come a time that they

[12:03]

would touch and and perhaps rub and see

[12:06]

each other naked but in the paraph files

[12:09]

there may be just a piece of that all of

[12:11]

that that they're particularly

[12:13]

interested in and we've broken it down

[12:16]

with these different names it's very

[12:18]

common to have multiple paraphilias and

[12:21]

one line of Research indicates that on

[12:23]

the average someone who has one

[12:25]

paraphilia is likely to have two to

[12:29]

three

[12:30]

paraphilia how do persons who have the

[12:33]

paraphilia adapt to the

[12:35]

paraphilia well there are a variety of

[12:38]

adaptations possible to those who are

[12:40]

going to live with uh with these urges

[12:44]

and and not make any effort to change

[12:46]

them those who choose to live with the

[12:51]

disorders can adapt lawfully or quasi

[12:56]

lawfully or unlawfully at the lawful end

[12:59]

of the scale the paraphile May confine

[13:03]

himself completely to

[13:06]

Fantasy so that when he is masturbating

[13:10]

he fantasizes about his unusual

[13:13]

interest when he is having sex with an

[13:16]

adult partner he fantasizes about his

[13:19]

particular interest and of course

[13:21]

there's nothing illegal about that and

[13:24]

he's able

[13:25]

to achieve an orgasm by anzing his

[13:29]

favorite activity even if he's engaging

[13:32]

in a part in sex with a partner who

[13:34]

doesn't quite fill the bill for what

[13:37]

he'd most like to be doing because the

[13:40]

fantasy in his mind allows him to have

[13:44]

all the excitement necessary to achieve

[13:46]

orgasm and so he's relieved the

[13:49]

biological urge or he's relieved his sex

[13:51]

drive in that

[13:53]

way another way that people lawfully

[13:56]

adapt is to find

[13:59]

a partner who's willing to simulate

[14:02]

whatever the unusual desired activity is

[14:06]

and who by agreement will wear

[14:08]

particular kinds of clothing or perform

[14:11]

particular kinds of Acts or pretend to

[14:14]

be something they are not in order to

[14:16]

fulfill the partner and that too is

[14:18]

perfectly legal so for example men with

[14:23]

necrofilia May merely fantasize about

[14:27]

corpses while they

[14:29]

masturbate or fantasize about corpses

[14:33]

while having sex with a Live partner or

[14:35]

they may find a consenting partner who

[14:37]

will simulate death and so this accounts

[14:40]

for men who from time to time will ask

[14:43]

their wives to take a cold bath before

[14:46]

having sex and to lie still with their

[14:49]

eyes closed that simulates a deathlike

[14:52]

condition and some wives will gratify

[14:54]

their

[14:55]

husband's fantasies and desires that way

[14:58]

which is

[14:59]

lawful one of the lawful adaptations of

[15:02]

an

[15:04]

necropile in addition to those there are

[15:06]

some things

[15:08]

that um begin to skirt some legalities

[15:12]

such as making use

[15:14]

of um pornography illegal obscenity or

[15:18]

pornography to fulfill the Fantasy by

[15:22]

looking at

[15:23]

pictures of whatever it is that is

[15:27]

stimulating

[15:30]

unusual or by finding a paid partner who

[15:34]

performs either Frank prostitution

[15:37]

Services of an unusual kind or else some

[15:40]

simulation for example in in uh West

[15:43]

Hollywood there are or at least there

[15:46]

were when I went out with the vice squad

[15:47]

and toured these places at least half a

[15:49]

dozen specialized bondage and domination

[15:53]

parlors where for a fee a man can have a

[15:56]

partner who will simulate

[15:59]

being a sexual Master will chain the

[16:03]

client and spank him or whip him or beat

[16:06]

him or on demand will play the role of a

[16:10]

slave and

[16:12]

allow the client to restrain and spank

[16:16]

and otherwise abuse the um person who

[16:20]

works there uh some such places engage

[16:24]

in outright prostitution and sell

[16:26]

explicitly sexual services others don't

[16:30]

some prostitutes cater specifically to

[16:32]

clients with these unusual tastes and

[16:35]

through those means using

[16:37]

pornography or these services or

[16:41]

prostitutes many paraphilic individuals

[16:45]

can gratify their sexual drives actually

[16:48]

engage in some of the sorts of things

[16:49]

that they um fantasize as most arousing

[16:54]

or have particularly high quality

[16:57]

photographs or imag of what they like

[17:00]

best and can fulfill their sexual drives

[17:04]

and gratify themselves in those

[17:06]

ways and then there are those of course

[17:08]

who adapt

[17:10]

unlawfully and who act on their

[17:13]

paraphilic desires by committing crimes

[17:17]

or commit crimes in order to be able to

[17:21]

fulfill the paraphilic desire so for

[17:25]

example there are fetishists who like a

[17:28]

particular particular kind of underwear

[17:31]

who will lawfully purchase it at a store

[17:35]

or quasi lawfully purchase it by mail

[17:37]

soiled from somebody in the business of

[17:39]

selling soiled

[17:42]

underwear but there are also others who

[17:44]

will commit the crime and shoplift

[17:45]

underwear or steal it from the

[17:47]

laundromat or steal it from a clothes

[17:49]

line or even burglarize a house to go

[17:51]

through an underwear drawer and steal

[17:53]

underwear from a victim those are all

[17:56]

varying ways that someone with that

[17:58]

fetish can adapt to the desire but only

[18:02]

some people commit the crimes to fulfill

[18:04]

their sexual

[18:06]

urges are there some paraph who never

[18:09]

never act out their

[18:11]

paraphilia probably most paraph never

[18:14]

act on their paraphilia in any criminal

[18:16]

way in terms of the person who wants to

[18:20]

stop involvement in a paraphilia would

[18:22]

you respond to what that person can do

[18:25]

looking first to the fantasy aspect and

[18:27]

then to the activity aspect the acting

[18:29]

out aspect well with all due respect I

[18:32]

think that the it's immaterial and

[18:34]

irrelevant to the issues before this

[18:36]

court that some paraphilias cannot do

[18:39]

certain things relative their paraphilia

[18:41]

is having any relevance in its inquiry

[18:43]

and objetive the form the

[18:45]

question objection over

[18:49]

rule well the paraphile

[18:52]

who chooses not to commit a

[18:55]

crime need not commit the crime he he

[18:59]

the paraphile is as free as any other

[19:02]

human being to choose whether to commit

[19:05]

a crime to gratify his wishes or to not

[19:08]

commit a crime to gratify his wishes

[19:11]

just as an individual who would like to

[19:13]

have

[19:14]

money fast and lots

[19:19]

is in our society free to choose to

[19:23]

commit a crime to get that money or go

[19:27]

about it the hard way and earn

[19:30]

it an individual who would like a

[19:33]

particular kind of

[19:35]

sex soon and a lot is free to commit a

[19:39]

crime to gratify that

[19:42]

desire or to choose not to commit the

[19:45]

crime but gratify the desire in these

[19:48]

other lawful or quasi lawful ways the

[19:52]

choice is exactly the same the freedom

[19:54]

to make it is the same the paraphilia

[19:58]

provides no more than the motive for

[20:01]

what a person would like to do it does

[20:03]

not determine whether the person does

[20:06]

it does not impair an

[20:09]

individual's appreciation of

[20:12]

wrongfulness nor does it impair an

[20:16]

individual's capacity to conform

[20:20]

conduct it only determines what it is

[20:22]

one wishes to

[20:26]

do now some paraph

[20:29]

files do commit crimes to gratify their

[20:33]

desires and when one looks at the paraph

[20:37]

files who commit crimes to gratify

[20:39]

themselves they are different in certain

[20:42]

ways from the paraph files who

[20:45]

don't just as people who want money and

[20:49]

commit crimes to get it differ from

[20:52]

people who want money and don't commit

[20:54]

crimes to get it and it turns out that

[20:56]

the differences are basically the saying

[20:59]

the people who commit crimes to get what

[21:01]

they want either have something wrong

[21:03]

with their personality their

[21:06]

character so that they are not inhibited

[21:08]

from the

[21:10]

crime because they don't have the

[21:12]

strength of character they don't have

[21:14]

the principles the morality the usual

[21:17]

things that keep people from committing

[21:19]

crimes or else the very the other very

[21:23]

common difference is that people who

[21:26]

abuse substances much more often commit

[21:29]

crimes to gratify their desires than

[21:32]

people who don't and so one finds that

[21:36]

paraphilic criminals are much more often

[21:39]

personality disordered alcoholic or drug

[21:43]

abusers than paraphilic

[21:46]

non-criminals just as robbers are much

[21:51]

more

[21:52]

often personality disordered or

[21:55]

alcoholic or drug abusers than other

[21:58]

people who'd like money but don't

[22:02]

Rob can you tell us what paraphilic

[22:05]

interest Mr dmer

[22:09]

has

[22:12]

well technically looking at the dsm3 our

[22:16]

approach to it one would point to

[22:20]

several very specific paraphilias that

[22:23]

are

[22:24]

described

[22:26]

um how however there's a broader

[22:29]

approach under which there's far more to

[22:31]

say about Mr D's particular

[22:36]

interests sticking to the to the more

[22:38]

technical approach to it

[22:41]

the three paraphilias that I think he

[22:45]

meets the criteria for are first

[22:50]

necrofilia because for more than six

[22:53]

months Mr

[22:55]

dmer had fantasies of and a desire to

[22:58]

have sexual contact with

[23:01]

corpses and in fact did

[23:03]

so and so that qualifies as

[23:08]

necrophilia

[23:10]

secondly um rism which is f o t t e r

[23:17]

ISM which refers to the desire to rub up

[23:22]

against someone else without their

[23:26]

consent the the evidence for that is

[23:30]

that there were occasions when Mr dmer

[23:32]

did that to strangers at

[23:36]

Summerfest in which he would go around

[23:39]

people where they were playing rock and

[23:41]

roll and drinking beer and he would rub

[23:44]

up he'd find a man with an attractive

[23:46]

physique and rub up against him he did

[23:49]

that on several occasions but more

[23:51]

importantly he did this with the men

[23:55]

that he brought back to his apartment

[23:56]

including the ones who became the

[23:58]

victims of the crimes with which he's

[24:00]

charged and the rubbing up against men

[24:04]

he had drugged in bathouses or uh at

[24:09]

hotels or at his grandmother's or at the

[24:13]

apartment whether he killed them or not

[24:15]

rubbing up against men when they're

[24:17]

drugged is rubbing against an

[24:19]

unconsenting partner and therefore

[24:21]

that's FR tourism and he did that for

[24:23]

more than six

[24:26]

months and the third

[24:28]

um that I

[24:30]

think one might say he has U requires a

[24:35]

little bit more of an explanation dsm3

[24:38]

R makes mention of a paraphilia known as

[24:43]

partialism partialism is an older term

[24:46]

and

[24:48]

it if my memory is correct on this I

[24:51]

think may have been I who recommended we

[24:53]

put it back in the book I I don't recall

[24:56]

clearly on that but I think I argued

[24:58]

that in favor of it and originally the

[25:01]

idea of partialism was to distinguish it

[25:05]

from fetish fetishism where a fetish is

[25:09]

some inanimate

[25:10]

object that the person finds attractive

[25:14]

in partialism it is a part of the human

[25:17]

body that one finds

[25:21]

attractive the most familiar kinds of

[25:26]

partialism that many clinicians have

[25:28]

seen and that are the subject of jokes

[25:31]

on shows like Night Court are foot

[25:37]

fetishism or hair fetishism these used

[25:41]

to be called

[25:43]

under dsm3 R those would be called

[25:47]

partialism rather than a fetish because

[25:50]

it's a part of the human body that's

[25:52]

sexually attractive namely feet or

[25:56]

hair for example example Mr dmer told me

[25:59]

about a man he had encountered at at a

[26:03]

bath house who apparently had a foot

[26:06]

fetish the man would um for prolonged

[26:10]

periods of time give other men's feet a

[26:14]

massage by taking the other man's foot

[26:17]

in his mouth and he would um suck on the

[26:20]

other man's foot and massage it with his

[26:23]

mouth for a prolonged

[26:25]

period that would be suggested

[26:28]

that such an individual had a foot

[26:30]

fetish or in current terms partialism

[26:35]

with respect to

[26:36]

feed the in the case of hair of course

[26:40]

it's normal for hair to be appealing and

[26:42]

there's an entire industry devoted to

[26:44]

making it so of hair products but where

[26:49]

men find hair by itself appealing and

[26:53]

for example

[26:55]

will cut the hair from a woman's head in

[26:59]

a crowded place or in a library and then

[27:01]

go home and masturbate while holding and

[27:04]

fondling the hair or looking at it

[27:06]

that's partialism it's only a part of

[27:08]

the person that becomes the focus of

[27:11]

attention well I think that partialism

[27:16]

could be applied to describe Mr D's

[27:20]

enduring interest in one particular part

[27:23]

of the human body namely the internal

[27:26]

organs some along the line he acquired a

[27:29]

sexual attraction to the appearance of

[27:32]

the

[27:34]

viscera which of course do have a

[27:36]

striking

[27:39]

appearance and as we described what

[27:42]

about it he found appealing uh it's my

[27:45]

understanding

[27:47]

that what he found appealing was the

[27:49]

glistening surfaces of the tissues the

[27:53]

fact that they were

[27:55]

colorful

[27:56]

and although partialism is usually

[28:00]

referring to things on the exterior of

[28:03]

the body perhaps the term applies here

[28:05]

and if it

[28:06]

doesn't then it would be one of the

[28:09]

other

[28:10]

paraphilias not otherwhere specified and

[28:14]

the Greek name that might be used for

[28:16]

that would be splank filia where splank

[28:19]

no refers to the viser and filia the

[28:22]

attraction to it I'm not aware of anyone

[28:25]

else using that term but several other

[28:27]

times

[28:28]

when someone's introduced some Greek

[28:31]

term for a paraphilia it turns out that

[28:33]

someone else had used the term 20 years

[28:35]

ago for the same thing or in the last

[28:36]

century because there's nothing new

[28:38]

about about any of these

[28:41]

conditions and um nor is Mr ders the

[28:44]

first case of someone with that

[28:46]

particular sexual attraction to the

[28:48]

appearance of

[28:50]

visca so can I just ask you doctor to

[28:54]

repeat the last thing Mr D is what did

[28:56]

you say uh I said Mr dmer is not the

[28:59]

first case of a sexual attraction to

[29:06]

visca those are the the particular

[29:09]

patterns that I gave diagnostic labels

[29:12]

to but I don't think that tells the

[29:14]

whole story of Mr D's sexual

[29:17]

interests because there's a really a

[29:20]

more important theme even than those and

[29:23]

that is that what I believe he has

[29:27]

considered consistently indicated and

[29:28]

his actions are consistent with the idea

[29:32]

that what is most appealing sexually to

[29:35]

him is having control over another

[29:41]

human in such a way that he can

[29:46]

make primarily gentle uses of their body

[29:52]

sexually the favorite activities he

[29:55]

describes are what he often refers to as

[29:58]

light sex kissing touching rubbing

[30:03]

hugging the kinds of activities that

[30:07]

between consenting adults would often

[30:09]

amount to foreplay are things that

[30:13]

he has

[30:15]

emphasized uh with victims and with

[30:19]

other

[30:21]

partners those were activities and and

[30:24]

those are normal activities with a

[30:25]

consenting adult that give him pleasure

[30:28]

and that he always

[30:30]

enjoyed but he

[30:34]

describes difficulty in getting Partners

[30:38]

to restrict themselves to just that

[30:42]

because the partners that he found most

[30:44]

often wanted to do more than that and

[30:46]

one of the things more than that that

[30:48]

some of them wanted to do was to have

[30:50]

anal sex with him which he did not like

[30:53]

having had a few painful experiences he

[30:56]

did not want to be in that

[30:59]

position also the partners that he was

[31:02]

able to

[31:02]

find universally had a deadline when

[31:06]

they had to leave and he was unable to

[31:09]

spend as much time as he wanted doing

[31:12]

these more

[31:14]

gentle ordinary activities with

[31:19]

them that desire to be able to do those

[31:22]

things

[31:24]

with the men he found attractive

[31:29]

is I think central to his desire

[31:35]

to be able to keep them in some way

[31:38]

where he could continue to do those

[31:40]

things without having demands on him

[31:44]

that were difficult to meet or painful

[31:46]

or that he didn't want to meet without

[31:48]

having a deadline by which it had to be

[31:52]

done and so he devoted a considerable

[31:54]

amount of his energy to finding a way to

[31:59]

be able to have

[32:01]

someone or if not someone

[32:05]

something

[32:06]

that could serve that role for him as

[32:10]

being the person or body or part with

[32:15]

whom he could have such gentle

[32:18]

activities as rubbing and touching and

[32:22]

hugging and masturbation and kissing and

[32:25]

fondling and

[32:27]

and it's in the course of trying to find

[32:30]

a way to keep a person for that that he

[32:33]

engages in most of the more extreme

[32:36]

behaviors surrounding the killings for

[32:39]

which he's

[32:43]

charged if I understood what Mr dmer

[32:45]

told me correctly and we spent a lot of

[32:47]

time on this during during my

[32:52]

examination his preference his first

[32:55]

choice would have been always to be able

[32:58]

to have a living breathing consenting

[33:03]

partner who permitted him to engage in

[33:06]

all of

[33:08]

these light sex to use his term

[33:12]

activities that were his

[33:15]

favorite and in fact he said to me that

[33:18]

had any of the victims agreed to stay

[33:21]

with him for several weeks then he would

[33:24]

not have killed them they' agreed to

[33:27]

stay and and do these things and there

[33:29]

were a few whom he found particularly

[33:32]

appealing because the physique was so

[33:34]

close to his ideal that um had he been

[33:37]

able to have a continuing relationship

[33:40]

with those men he felt he would have had

[33:42]

no need for any of the rest of what he

[33:44]

did no particular desire to do it

[33:47]

likewise there were a couple ideal men

[33:51]

in videos whom uh he sh pointed out to

[33:56]

me and described what it was about the

[33:58]

physique he liked

[33:59]

so which had they been available to him

[34:03]

as consenting Partners would have been

[34:06]

all that he wanted or felt a need for to

[34:10]

fulfill himself

[34:13]

sexually but those ideal men weren't

[34:17]

obtainable and the men who came as close

[34:20]

to it as he found such as Mr

[34:23]

Sears were going to have to leave by

[34:27]

deadline they had some time they had to

[34:30]

go so if he couldn't have them in that

[34:34]

way as a consenting continuing partner

[34:39]

the second best

[34:41]

way would be to have them in some other

[34:46]

state in which they would remain with

[34:50]

him and still be available for these

[34:53]

activities and the second choice that

[34:57]

would be best for him he thought would

[34:59]

have been if he could have had one of

[35:01]

them whose will had been

[35:05]

destroyed he wanted to be able to take

[35:09]

one of the men and make it so that that

[35:13]

man had no will of his

[35:18]

own the term he used to describe these

[35:22]

people with no free will that he wanted

[35:24]

to create was the term zombie

[35:28]

and he tried two techniques for the

[35:32]

creation of

[35:33]

zombies the point of having a zombie was

[35:37]

that he would

[35:39]

have a living breathing

[35:42]

warm human and one of the things he

[35:45]

liked about that was that this interest

[35:48]

in the visca led him to enjoy listening

[35:51]

to the sounds of the internal organs

[35:53]

listening to the heartbeat listening to

[35:56]

the

[35:57]

sounds that an abdomen makes hearing the

[36:01]

body

[36:02]

sounds was both reassuring and exciting

[36:05]

to him and so he would ask victims if he

[36:08]

could listen to

[36:09]

them or he would ask partners that and

[36:12]

after drugging men it's one of the

[36:14]

things he would do was to listen to

[36:15]

their body sounds well with a zombie had

[36:18]

he succeeded he would he thought be able

[36:20]

to continue to do all the things he

[36:22]

liked including

[36:25]

that and the two techniques he actually

[36:27]

tried

[36:29]

were of course drilling into the uh

[36:33]

skull and injecting acid into the what

[36:37]

he thought would be the frontal lobe

[36:38]

region and likewise drilling into the

[36:41]

skull and injecting boiling water into

[36:43]

the frontal lobe region he considered

[36:46]

another possibility which was uh

[36:50]

drilling a

[36:52]

hole more at the um at top of the skull

[36:55]

and inserting

[36:57]

some electrical apparatus plugging this

[36:59]

into the wall to try to use electricity

[37:01]

to achieve the goal but he felt he

[37:03]

lacked the technical knowledge of

[37:05]

electricity to do this and told me he

[37:07]

didn't really know how to make a switch

[37:08]

or a rat but that he' thought about the

[37:12]

idea the purpose here was to have

[37:15]

someone who wouldn't leave him who

[37:17]

wouldn't make demands who wouldn't turn

[37:20]

him in who would do none of these other

[37:23]

problematic things and yet who would be

[37:25]

available as a sexual partner partner

[37:27]

and so in that sense what these zombies

[37:30]

would be would be sex slaves who meet

[37:34]

his particular sexual

[37:37]

desires and Mr dmer is not the

[37:42]

first paraphilic and nor the first

[37:46]

serial killer to wish to create sex

[37:49]

slaves and to take steps to try to

[37:51]

create such

[37:52]

persons who would be available for his

[37:55]

sexual use

[37:59]

his third choice and one that he often

[38:02]

uh got really was an unconscious

[38:06]

partner because someone who is

[38:10]

unconscious but alive allows him to do

[38:14]

all of those things that he likes to do

[38:18]

like kissing and rubbing and listening

[38:19]

to body sounds and touching and

[38:23]

hugging and of course that he did

[38:27]

many times at

[38:30]

bathouses a number of times at hotels to

[38:33]

which he took men from the from the

[38:37]

bars with all of the

[38:43]

victims whom he's charged with killing

[38:46]

and with some of the people who got

[38:49]

away and that activity of drugging them

[38:54]

allows him a period of hours

[38:57]

when he uses the dose he

[38:59]

preferred during which he can engage in

[39:03]

all of these activities with an

[39:05]

individual without having demands made

[39:07]

on him without having somebody who's

[39:10]

going to get up and leave in the middle

[39:11]

of what he's

[39:12]

enjoying where he has enough time to

[39:14]

masturbate several times and

[39:18]

to fulfill himself sexually in all of

[39:21]

these ways that unconscious victim mode

[39:27]

was of of course his principal means of

[39:30]

gratification for some period when he

[39:32]

was going to the bathouses a lot but he

[39:36]

continued to use that with the other

[39:38]

victims and while not as good as the

[39:41]

consenting awake partner who was

[39:44]

compliant with all this it

[39:47]

was certainly sufficiently fulfilling

[39:50]

for him the problem of course is

[39:54]

that keeping them unconscious ious long

[39:58]

enough would be difficult to do keeping

[40:01]

them alive while unconscious would be

[40:03]

difficult to do and if they regain

[40:06]

Consciousness

[40:08]

sufficiently they may escape and may

[40:11]

turn them in for doing it as in fact uh

[40:16]

nearly

[40:17]

happened uh earlier and did happen

[40:23]

eventually his next choice after that

[40:27]

and one he only thought about

[40:30]

and went to the library to look into

[40:33]

briefly was that if he could

[40:37]

find one man with sufficiently

[40:41]

attractive

[40:42]

physique to keep permanently while

[40:46]

dead that would be useful because he

[40:48]

could do many of the things he wanted

[40:50]

though not quite all and here what he

[40:53]

considered

[40:55]

was something he heard about on a TV

[40:57]

show U when we discussed it we both

[41:00]

thought we might have seen it on 60

[41:02]

Minutes but U neither he nor I am sure

[41:06]

of the particular

[41:08]

show but one show did something on

[41:12]

people who freeze dried their

[41:14]

pets and Mr D's idea was that if he

[41:18]

could get the apparatus for that and

[41:20]

freeze dry a man of the appropriate

[41:25]

physique he'd at least be able to

[41:28]

continue to have him to look at while

[41:30]

masturbating to pose perhaps in various

[41:33]

positions if they were flexible enough

[41:35]

in that state to fondle to rub to hug to

[41:42]

touch they would not have sounds to

[41:45]

listen to but they would have a lot of

[41:47]

what he was interested in and he thought

[41:50]

that if he'd been able to fre dry one of

[41:54]

the more attractive men that he would

[41:57]

not have had a desire for the other

[42:00]

victims the step he took was to go to

[42:02]

the library and in a magazine he thought

[42:05]

was called

[42:06]

Taxidermy found an advertisement from A

[42:09]

supplier of the equipment for freeze

[42:11]

drying animals and found that there were

[42:14]

two sizes of the machines one of which

[42:17]

seemed like it might be large enough for

[42:19]

humans but the cost was prohibitive it

[42:22]

cost $330,000 or so he thought and so

[42:25]

that was not an available

[42:31]

option the next best

[42:35]

choice was that of a fresh

[42:40]

corpse now the fresh corpse like the

[42:43]

freeze-dried person has the problem of

[42:45]

not having any sounds to listen to but

[42:48]

it has the additional problem that it

[42:50]

will not stay

[42:52]

fresh and that

[42:55]

decomposition

[42:57]

is a risky business because of the

[42:59]

accompanying

[43:00]

odors and uh he had close calls because

[43:03]

of the oders at the apartment with

[43:06]

getting

[43:07]

caught uh still when he

[43:11]

committed the

[43:13]

murders excuse me the killings with

[43:15]

which he's charged

[43:18]

the availability then of a fresh corpse

[43:22]

was such that he made use of that

[43:25]

sexually and

[43:26]

at least most of the instances for the

[43:29]

few days where it was feasible to do

[43:32]

that and

[43:36]

that use of those corpses and his

[43:40]

interest in that and these other

[43:42]

activities underlies my diagnosis of

[43:45]

necrophilia even though it wasn't his

[43:47]

preferred activity certainly not his

[43:50]

exclusive

[43:52]

activity it was um it it was a

[43:57]

compromise to what he would rather have

[43:59]

been doing but an acceptable compromise

[44:02]

that he employed a number of times and

[44:04]

he actually did

[44:06]

consider obtaining corpses through other

[44:10]

means having at one point looked at the

[44:15]

obituaries to try to

[44:17]

spot notices of the deaths of young

[44:21]

males and by Young here I mean late

[44:23]

adolescent or young adults his never had

[44:26]

any known interest in Children Under

[44:29]

12 but

[44:31]

that um that attraction

[44:34]

to men from 16 to

[44:39]

25 if he could find one who

[44:43]

died recently he thought he might be

[44:46]

able to obtain access to the corpse and

[44:48]

he in fact went to two funerals in

[44:51]

pursuit of that goal one where there was

[44:54]

a closed casket and so he didn't know if

[44:56]

the U man would have been attracted the

[44:59]

other where there was an open casket and

[45:01]

he told me that he did found that young

[45:04]

man attractive and subsequently went to

[45:06]

the cemetery at night with the plan of

[45:09]

digging up the grave and having access

[45:11]

to that corpse but the ground was too

[45:14]

hard because of the cold weather and so

[45:17]

he couldn't dig and it got frightening

[45:19]

in the cemetery because he heard typical

[45:22]

horror movie sounds of a dog barking and

[45:24]

an Al hooting and so got out of there

[45:27]

and was unable to use that

[45:37]

means lastly uh along this spectrum

[45:43]

of people or bodies or parts under his

[45:47]

control was the other uses he made of

[45:53]

Those whom he in fact had killed and

[45:56]

here he told me that he made use of the

[46:00]

viscera for masturbation by opening the

[46:07]

victims in the course of dismembering

[46:09]

them and there was a particular phase of

[46:12]

of dismemberment where he would stop

[46:15]

sometimes to take photographs sometimes

[46:17]

to masturbate sometimes both and that

[46:20]

was upon opening the abdomen when the

[46:24]

abdominal viscera are first exposed and

[46:27]

he would masturbate while looking at

[46:29]

that and that was a longstanding image

[46:32]

as far as I could determine that was an

[46:34]

interest he had had since late uh late

[46:37]

in high

[46:38]

school and this gave him occasion to

[46:40]

make use of that particular

[46:44]

image

[46:48]

and that's basically this spectrum of

[46:51]

controlling another person now to call

[46:54]

all of that just necrofilia really sort

[46:56]

of misses the mark but it's it's the

[46:59]

best word we have at the moment for it

[47:01]

we'd be better off having some other

[47:03]

term that describes this whole range of

[47:05]

wanting to have someone under

[47:08]

control the reason we don't is that the

[47:12]

issue arises for all the

[47:15]

paraphilias because in every

[47:18]

paraphilia what the paraphile wants is

[47:22]

to be able to do this favorite thing or

[47:24]

this special thing without much regard

[47:27]

to whether other people like that or

[47:30]

find it appealing the paraphile wants to

[47:33]

do it when he wants to do it on his own

[47:35]

terms and so there's always some issue

[47:37]

of control with all the

[47:40]

paraphilias and secondly in the case of

[47:43]

some of the paraphilias there's a really

[47:46]

overt obvious interest in controlling

[47:50]

some person particularly in the

[47:52]

paraphilia related to rape and to sexual

[47:55]

SA ISM there is a uh an overt conscious

[48:01]

desire to control and cause harm to

[48:03]

another human but Mr dmer is different

[48:06]

from that because as far as I could

[48:09]

tell his statements were always

[48:12]

consistent to me and his behavior at

[48:15]

least up

[48:17]

until Tracy Edwards as far as it can be

[48:21]

adduced from all the evidence was such

[48:23]

that he did not torture his victims

[48:27]

and took steps to prevent them from

[48:30]

suffering whereas in in sadism they take

[48:33]

steps to promote suffering Mr dmer took

[48:36]

steps to alleviate suffering and to

[48:39]

ensure that the victims would not be

[48:40]

experiencing

[48:43]

pain so control is a difficult concept

[48:47]

with the

[48:48]

paraphilia present in some degree in all

[48:52]

the paraphilias and an important concept

[48:54]

for Mr D

[48:57]

but what he wanted was these more gentle

[48:59]

activities with the other

[49:01]

people we'll we'll talk a little later

[49:04]

about the fact that the killing being

[49:05]

something apart from the paraphilia

[49:07]

something in which he did not take

[49:09]

pleasure is that

[49:10]

correct we address that issue later

[49:13]

that's right with respect to did you

[49:16]

form any opinion as to how Mr dmer got

[49:18]

this way acquired these

[49:21]

paraphilias well I think the evidence

[49:24]

that exists from from his history from

[49:27]

talking to him is suggestive of how he

[49:31]

got this way and um that

[49:35]

is specifically the timing of his first

[49:40]

fantasies of such

[49:42]

activities and what was going on in his

[49:44]

life at the time the timing of his first

[49:48]

fantasies of bringing another person

[49:52]

under his control in order to engage in

[49:55]

sexual

[49:56]

behaviors was sometime during the high

[50:00]

school years at various times the

[50:03]

specific age and grade that Mr dmer has

[50:06]

said this occurred has varied uh within

[50:08]

a year or two but it seems to be around

[50:12]

age 15 or

[50:15]

16 that he first

[50:19]

had sexual thoughts of striking another

[50:23]

person and rendering him unconscious by

[50:26]

a blow to the back of the

[50:28]

neck and then making sexual use of the

[50:31]

unconscious

[50:33]

body the first time he tried or meant to

[50:36]

act on that was when at around that age

[50:40]

he found a particular male jogger

[50:43]

attractive to him and

[50:47]

he I believe broke off a baseball bat

[50:52]

and

[50:53]

then he uh concealed himself in some

[50:57]

brush near where the jogger was expected

[51:00]

to pass with the idea that if the jogger

[51:03]

came by he would strike him on the back

[51:06]

of the neck make him unconscious and

[51:09]

enjoy the man's body sexually for a

[51:13]

Time the jogger didn't come by and so

[51:16]

that didn't come to pass and Mr dmer

[51:18]

never saw the man again but that seems

[51:21]

to be the first effort to put this

[51:23]

fantasy into action but the fantasy

[51:25]

always precedes the action and so he

[51:29]

must have had a fantasy of such things

[51:31]

before he went to try to do it and he

[51:34]

acknowledges that he had the fantasy

[51:38]

earlier it was also around that time

[51:42]

that he told me he first had

[51:44]

any sexual thoughts about

[51:49]

visera now if one tries to uh look at

[51:52]

the origins of that there are several

[51:54]

things that seem possible origins of

[51:57]

those paraphilic interests at at that

[52:01]

age one is that there was a ninth grade

[52:05]

science project of dissecting a fetal

[52:07]

pig and while all the children had the

[52:10]

project it was Mr dmer who obtained the

[52:14]

teacher's permission to take home what

[52:16]

was left from the dissection of the

[52:18]

pig's head and at home he made further

[52:22]

use of it to try to preserve the skull

[52:26]

there was nothing overtly sexual about

[52:28]

that activity for him it didn't sexually

[52:30]

excite him and he didn't have sex in

[52:33]

mind but it was an exposure to that kind

[52:36]

of contact with the tissue of a

[52:40]

mammal that occurred around that time in

[52:43]

his life

[52:45]

that may have and he acknowledges that

[52:49]

this may have occurred may have entered

[52:51]

into his

[52:54]

mind at a time when he was in fact

[52:58]

beginning to masturbate regularly and

[53:02]

frequently in ninth grade at about age

[53:06]

15 he was approximately one year into

[53:10]

his pubescent sexual activity he'

[53:14]

engaged in

[53:16]

some sex play with a neighborhood boy

[53:19]

about his age and he was

[53:22]

masturbating on a regular basis

[53:24]

sometimes as often as two or three times

[53:26]

a day at that

[53:28]

period and and as boys will do when they

[53:32]

masturbate they think about various

[53:35]

things and I believe the the evidence on

[53:38]

the paraphilia shows that what boys

[53:41]

think about while they masturbate is

[53:43]

often incorporated into their subsequent

[53:47]

fantasies and will is often the origin

[53:50]

of their later sexual interests so so

[53:55]

that what a boy repeatedly Associates in

[53:58]

his mind with sexual arousal becomes

[54:02]

what he will want for a very long time

[54:05]

to do sexually and so it may be that the

[54:09]

thoughts of the fetal pig entered Mr D's

[54:13]

mind just because of the timing that he

[54:15]

happened to have been doing that around

[54:17]

the time he's masturbating the thought

[54:19]

wanders into his mind and then it

[54:21]

becomes

[54:23]

sexualized the next time he masturbates

[54:25]

it's a little more likely to enter his

[54:27]

mind again and if it enters his mind

[54:29]

enough while he masturbates eventually

[54:31]

it comes to be a sexy thought even

[54:33]

though a year

[54:35]

earlier the thought of tissue would not

[54:38]

be sexy to him any more than it is to

[54:40]

most

[54:43]

people another incident that occurred

[54:45]

around the same time was a class trip in

[54:47]

his junior year to a museum he thought

[54:51]

it was an acine I believe in fact the

[54:53]

evidence indicates it's in Cleveland but

[54:56]

a

[54:57]

museum where he saw for the first

[55:03]

time portions

[55:06]

of a human

[55:09]

body

[55:12]

when at the Museum he saw what are known

[55:16]

as transverse sections of the body um

[55:20]

these are used for anatomical study and

[55:23]

uh every medical student

[55:26]

because through the initial experience

[55:27]

of some revulsion at seeing these and

[55:30]

eventually having to study them to learn

[55:33]

the anatomy but the um preparations are

[55:36]

made

[55:38]

by preserving a human Cav and then

[55:42]

slicing very thin sections of the cadav

[55:46]

preserving those slices in such a way

[55:48]

that they can be seen and Mr dmer saw

[55:51]

these slices of a human body at the

[55:53]

Museum and and he and the others stood

[55:56]

around looking at these slices of a

[55:59]

human body for about half an

[56:02]

hour he um told me he hadn't thought of

[56:06]

that particular incident in years until

[56:08]

I asked him about it and um he was

[56:11]

surprised to remember it and although

[56:15]

does not recall that entering his

[56:17]

masturbation fantasies allowed as how

[56:19]

that that too may have had some

[56:21]

influence

[56:23]

here uh like wise it was around the same

[56:27]

age I think around 9th grade that he was

[56:29]

struck by a uh group of boys there were

[56:33]

some seniors from school who saw him

[56:36]

walking home one night and struck him in

[56:38]

the back of the neck with what at one

[56:41]

point he said was a billy club at

[56:43]

another point he described it as a

[56:44]

blackjack but whatever it was someone

[56:46]

hit him in the back of the neck and he R

[56:48]

ran home

[56:49]

terrified about that and that that was a

[56:53]

significant event to him for which he

[56:55]

had some fantasies of of retaliation and

[57:00]

some emotional response to having been a

[57:03]

victim of

[57:05]

that likewise it was around this time

[57:08]

that Mr dmer did engage in some

[57:11]

dissection of animals that he'd brought

[57:14]

home if he spotted them killed along the

[57:16]

road in one instance he was playing

[57:19]

something of a practical joke on his

[57:20]

friends and he set up a bizarre scene in

[57:24]

the woods with the dog's head out on a

[57:26]

tree and led his friends there without

[57:28]

telling them that um that he'd put it

[57:31]

there so they feel as if they all

[57:33]

discovered it at once because he wanted

[57:35]

to to scare them but at other times on

[57:38]

his own he would do a dissection chiefly

[57:42]

for the goal of getting the bones which

[57:44]

he thought he might sometime assemble

[57:46]

and and Preserve in a

[57:48]

skeleton as far as I could tell Mr dmer

[57:51]

was not sexually aroused by those

[57:54]

activities

[57:55]

but found there was some excitement in

[57:57]

doing something that unusual found some

[58:01]

Discovery there the first time he this

[58:04]

much earlier when the first time he cut

[58:05]

a fish and saw the bright orange color

[58:07]

of of the egg sack he was surprised at

[58:10]

that and later when he saw the color of

[58:14]

organs inside a mammal that was a

[58:16]

surprise and there was some excitement

[58:17]

in doing this but he didn't consciously

[58:20]

recognize it as sexual and it probably

[58:22]

therefore wasn't

[58:25]

however somewhere and probably at that

[58:28]

time these things

[58:29]

became sexualized to him which is a way

[58:33]

of saying that he learned to think of

[58:36]

these odd things as

[58:38]

sexy where most people don't find these

[58:41]

things

[58:42]

sexy and you you want you indicated you

[58:45]

wanted to qualify this discussion about

[58:47]

the causation you wanted to add some

[58:49]

qualifying remarks on that yes I I

[58:51]

should point out that um I can't offer

[58:54]

an opinion with reasonable medical

[58:56]

certainty of the precise origins of Mr

[58:59]

Dahmer's paraphilia but as far as I can

[59:02]

determine it's the events in that time

[59:05]

at that time of his life that led to his

[59:07]

acquiring the paraphilia just so the

[59:10]

jury understands this qualifier applies

[59:12]

just to the causation the youthful

[59:14]

causation that caused the connection the

[59:16]

sexual stimulus with those particular

[59:18]

activities is that correct yes because

[59:20]

there's still some um debate in the

[59:23]

profession as to the causes of

[59:25]

paraphilia does the fact that dmer had

[59:28]

these paraphilic interests require that

[59:30]

he act on

[59:32]

them no having paraphilic

[59:36]

interests means nothing more than what

[59:39]

it is that will produce in the male an

[59:42]

erection the

[59:44]

paraphilia is a description of what is

[59:47]

sexually

[59:48]

exciting whether one acts to seek out

[59:52]

that

[59:53]

image in very in ways is not determined

[59:57]

by the paraphilia but by other aspects

[60:01]

of one's life one's morals one's

[60:03]

character whether one drinks all these

[60:05]

other

[60:07]

things but I think it is important to

[60:09]

point out

[60:11]

that a acquiring a paraphilia is

[60:14]

generally not a matter of choice Mr dmer

[60:18]

couldn't help what became sexy to him or

[60:22]

couldn't have known at that point in his

[60:24]

life how to control

[60:26]

that uh and what remained attractive to

[60:30]

him over the

[60:31]

years was as much an inherent part of

[60:35]

him as any human's idea of what is sexy

[60:39]

becomes an inherent part of that person

[60:41]

and we don't generally choose what we

[60:44]

will find sexy it happens to us in ways

[60:47]

we're not quite aware of what humans do

[60:50]

choose is whether they will act on their

[60:54]

sexual ual interests or not and in the

[60:57]

same way that an individual chooses

[61:00]

whether to reach out and touch each

[61:03]

attractive person he sees a paraphile is

[61:07]

able to decide whether to reach out and

[61:09]

do those things that will gratify his

[61:13]

attractions excuse me can I ask you just

[61:15]

Mark that answer and I'll ask you about

[61:18]

it later at a rep thank

[61:20]

you what is the role of character then

[61:23]

in a person who has a

[61:26]

paraphilia well character largely

[61:29]

determines or paraphile and everyone

[61:33]

else how they will go about their lives

[61:37]

how they will behave themselves um in

[61:41]

Psychiatry we use now the term

[61:46]

personality traits to describe

[61:51]

enduring ways people tend to respond to

[61:53]

the world

[61:55]

and if individuals

[61:58]

have personality traits that cause them

[62:01]

problems or get them in

[62:04]

trouble or that make them unhappy or

[62:07]

that lead to their being unfulfilled in

[62:09]

life we will

[62:12]

sometimes give a diagnosis of a

[62:14]

personality disorder which refers

[62:18]

to nothing more than a set

[62:21]

of personality traits that are causing

[62:24]

stress or getting people in

[62:27]

trouble when individuals have

[62:31]

personality disorders or when they've

[62:33]

got some strong personality traits that

[62:36]

are not functional don't work too well

[62:39]

in the world then they may get in

[62:42]

trouble with the

[62:44]

law as they go about their business in

[62:47]

the case of a paraphile because there's

[62:49]

always this interest in doing the sexual

[62:53]

activity that's desired at least

[62:56]

whenever the sex drive is there the

[62:58]

interest is there to to do the thing

[63:00]

they find sexually

[63:01]

attractive if there's also a problem

[63:03]

with character they may commit crimes in

[63:06]

order to fulfill the sexual desire and

[63:09]

that problem with character is separate

[63:11]

and a thing apart from the paraphilia is

[63:13]

that correct that's right are most sex

[63:17]

criminals both sexually deviate and

[63:20]

possessed of some antisocial personality

[63:23]

characteristics or traits I wouldn't use

[63:26]

the word possessed here that conjures up

[63:28]

some other images but U but it is true

[63:31]

that most sex

[63:33]

criminals have both well leaving aside

[63:36]

rapists for a moment other sex offenders

[63:40]

most of whom are

[63:41]

paraphilic

[63:44]

have both a paraphilia and a personality

[63:49]

disorder of some kind um most commonly

[63:53]

an antisocial personality it disorder

[63:55]

but I don't think Mr dmer has an

[63:56]

antisocial personality disorder you will

[63:59]

speak to some of his traits however

[64:01]

personality traits later on in your

[64:03]

conclusionary remarks that affected and

[64:05]

interlaced with the paraphilia is that

[64:07]

correct

[64:08]

probably what role does alcohol play in

[64:11]

Mr D's situation and how did that

[64:13]

interface with his paraphilia and with

[64:15]

his

[64:17]

character well in Mr D's case his

[64:20]

drinking was very important in

[64:22]

understanding the crimes with which is

[64:25]

charged

[64:29]

the the way that paraphilic

[64:32]

offenders who aren't character

[64:37]

disordered get to be offenders instead

[64:40]

of law-abiding people is

[64:43]

often because of substance abuse other

[64:46]

words because the paraphilia doesn't

[64:48]

cause anyone to commit a crime we have

[64:51]

to ask ourselves how does why is it some

[64:53]

parap files commit crimes well some do

[64:56]

because they're bad people they have an

[64:57]

antisocial personality disorder and they

[65:00]

don't care about anyone else so they

[65:02]

just do it some do because they're

[65:06]

alcoholic and they lower their

[65:08]

inhibitions with drinking and then do

[65:10]

these things they want to do others for

[65:12]

other drugs or for other personality

[65:14]

disorders but it's not because of the

[65:16]

paraphilia it's because of these other

[65:18]

problems that lower their inhibitions or

[65:22]

that caused them not to have any inh

[65:24]

inhibitions in the first place that

[65:26]

they'll commit the crimes merely to

[65:28]

satisfy themselves sexually in Mr D's

[65:31]

case I think the key element as to

[65:34]

why uh he did

[65:38]

not confine himself to Fantasy and

[65:42]

masturbation is that he was also

[65:45]

drinking very heavily because of his

[65:48]

alcohol abuse he was often lowering his

[65:52]

inhibitions and in that state would find

[65:55]

it capable to engage in a series of

[65:58]

things that without drinking were very

[66:01]

difficult for

[66:02]

him to begin

[66:06]

with Mr dmer is not a particularly

[66:11]

extroverted person

[66:15]

he can speak comfortably to people he's

[66:18]

not so inhibited

[66:22]

from social contact it makes him anxious

[66:25]

just to have a conversation he can have

[66:27]

carry on normal conversations with with

[66:30]

with anyone and and be polite and have

[66:32]

no problem with that but he was a

[66:35]

private person and not very outgoing

[66:38]

particularly as he was engaging in um

[66:41]

antisocial Behavior withdrew from other

[66:44]

people he saw the Turning Point as

[66:47]

the Hicks homicide I think when he began

[66:50]

to drink very heavily and withdraw from

[66:52]

other people and so from right after

[66:56]

high school on he

[66:59]

had

[67:01]

been a heavy drinker much of the time

[67:05]

and had had few if any close

[67:08]

friends now because

[67:11]

he had few or no close friends After

[67:16]

High

[67:17]

School it was a difficult thing for Mr

[67:20]

dmer to go meet someone to develop a

[67:24]

sexual

[67:26]

relationship and part of the reason he

[67:28]

would drink on weekends was to be able

[67:32]

to work up the courage to go meet

[67:34]

someone in the same way that that

[67:36]

heterosexual men will sometimes go to a

[67:39]

bar and have a few drinks before they

[67:41]

would approach a woman because they want

[67:43]

to overcome some of this inhibition it's

[67:46]

it's the same here but another reason he

[67:49]

would

[67:50]

drink

[67:52]

is that

[67:56]

when he was alone with those whom he

[67:59]

meant to harm he would have inhibitions

[68:03]

against the

[68:05]

killing that he would need to drink to

[68:09]

overcome now that's

[68:11]

because Mr dmer doesn't have any

[68:14]

paraphilia about killing

[68:16]

people he never

[68:19]

did he has paraphilia about doing gentle

[68:23]

things with people

[68:24]

and and foreplay like things with them

[68:28]

and I think he has a paraphilia about

[68:29]

looking at viscera but killing people is

[68:33]

not a paraphilia for

[68:36]

him and nor is the actual dismemberment

[68:40]

or disposal

[68:42]

of corpses sexually appealing to him

[68:47]

those were two things that he

[68:48]

particularly disliked he didn't like to

[68:51]

kill and he didn't like to dism

[68:56]

M though there was a piece of the

[68:58]

mutilation that he liked which is when

[69:00]

you look at the abdomen but the rest of

[69:02]

it was hard work and some of it

[69:05]

absolutely repulsive to him just as it

[69:07]

would be to anyone until he desensitized

[69:11]

himself by doing it so often that it was

[69:14]

just a dirty

[69:18]

job and he would drink to overcome the

[69:20]

inhibitions against those two

[69:22]

unattractive aspects of this process The

[69:26]

Killing and the

[69:28]

dismemberment and he told me that he

[69:30]

would uh always drank to overcome

[69:33]

inhibitions against

[69:34]

killing and to overcome inhibitions

[69:37]

against

[69:38]

dismemberment so then the killing itself

[69:41]

was not a part of the paraphilia

[69:45]

no because I phrased it negatively let

[69:48]

me rephrase it is the killing a part of

[69:50]

the

[69:51]

paraphilia not for Mr dmer it isn't

[69:55]

does a paraphilia attraction cause a

[69:58]

compulsion and if and and if not why

[70:03]

not a paraphilic

[70:05]

attraction uh that

[70:14]

await you know I've often used the

[70:16]

expression that a bomb doesn't go off in

[70:18]

this courtroom at a certain time that we

[70:21]

have to quit but I noticed that the

[70:23]

[Music]

[70:28]

do sounds pretty good to

[70:35]

me like I repeat the question thanks I

[70:37]

remember it there there are two

[70:39]

different

[70:41]

uh ways to look at the concept of

[70:44]

compulsion in medicine and Psychiatry we

[70:47]

mean something very specific by

[70:49]

compulsion a

[70:51]

compulsion is a senseless activity that

[70:56]

the individual recognizes is

[71:00]

senseless and for

[71:05]

which I'm sorry I didn't phrase it well

[71:08]

and which the individual engages in this

[71:12]

activity in order to avoid some dreaded

[71:18]

harm or

[71:20]

to avoid something

[71:29]

unpleasant does that complete your

[71:30]

answer dor no no it doesn't

[71:46]

okay this is a every Wednesday so you

[71:49]

know doctor is a

[71:52]

visitor

[71:57]

do we want to break judge and restart it

[72:02]

this okay why don't we break and we'll

[72:04]

go back to that last question then if

[72:07]

that's satisfactory with you Mr Manan

[72:09]

that's we will do a c and

[72:11]

Rec all right

[72:22]

pleas
